LITIGATION-PROOF PATENTS Avoiding the Most Common Patent Mistakes explains the principles of excellent patents, presents the ten most common errors in patents, and details a step-by-step method for avoiding these common errors. Specific patents are analyzed and shown to commit or avoid the most common patent mistakes. The book includes four chapters. • First, a step-by-step process for writing outstanding patents that capture all the innovative points of an invention and that avoid the most common patent mistakes. • Second, principles of litigation-proof patents, including characteristics of good patent claims, Key Claim Terms, patent value, seminal patents, and tips for writing patent applications. • Third, the ten most common mistakes that appear frequently in patents, and that destroy both patent quality and patent value. • Fourth, five patents that illustrate the concept of “litigation-proof patents”. These patents include the Hedy Lamarr frequency hopping patent from World War II, the patents for the board game Monopoly®, and the “slide-to-unlock” mobile phone patent that Apple asserted against Samsung. LITIGATION-PROOF PATENTS is intended for anyone writing a patent who wants to achieve the highest-possible quality. It is intended for patent evaluators who want to understand whether or not the patents being reviewed suffer from value-destroying mistakes. It is intended for patent managers and heads of IP departments who are managing significant patent portfolios, and who want to understand the relative quality of their portfolios. LITIGATION-PROOF PATENTS is the second of three books the make up the Patent Quality Series. The first book in the series, TRUE PATENT VALUE Defining Quality in Patents and Patent Portfolios, was published in 2013, and the third book in the series, PATENT PORTFOLIOS Quality, Creation, and Cost, will be published soon.

First, this is a really great book, in that lawyers should buy it, give to someone who wants to write his own patent, then they will think the process is so confusing that he needs to hire a lawyer. Second, I am not a lawyer, but, I just read "Patent it yourself" and "Invention analysis and claiming, Slusky". Neither are great, but good yes. This book is very very terse. Few examples are given, the "bad way" to write a patent, but then the "good way" is not spelled out. Likely much more understandable if you are a lawyer, but I think if you can understand this book, then you don't need it. If you are a lawyer there is some tips and info I am sure of value. But there are only two patents cases discussed, in detail, yet for me not explained enough. The Slusky book did it a lot better in my opinion. There are footnotes in this book that are needless and take up space. A bibliography, who cares? Definitions, who needs them if you are a lawyer? Appendix! So much wasted space in this little book of 225 pages. The contents of this book I would think came out of a one hour lecture give to law students. That, was likely a great lecture. But I actually read this book in one day. (I have to reread it to learn it, I'll admit. I didn't get all the points in the first read.) The Slusky book and "Patent it yourself" took me several days each. And I had to go back and forth. But there is a lot of content in them. If you are a patent lawyer this may be a great book. For someone who is just trying to understand the system this is not the first book to begin with.

Very hands on information, also suitable for the patent savvy inventor
This book is not "Patents for Dummies". If you've never read a patent before, go with the Nolo books instead. But if you know the difference between a Markman hearing and a means-plus-function, this book is pure gold.
An excellent and well written book. I wish I'd had this book 30 years ago - would have made 100 patents come to life. Thank you, Larry.
Excellent Book! It is very clear and an easy read with great advice on writing strong patents from a litigation viewpoint. Although I have been drafting for years, I have added several reminders to my current drafting checklist based on tips from this well written book. Well done Mr. Goldstein and thank you!
